EB-3 Other Workers, explained
EB-3 Other Workers, often called EB-3 unskilled, is a U.S. employment-based green card category for permanent, full-time jobs that need less than two years of training or experience. A U.S. employer offers the job and sponsors the worker, and the worker's spouse and unmarried children under 21 receive green cards too.
- No degree or English test is required by law; the employer sets the job requirements.
- The employer pays for PERM labor certification, as required by 20 CFR 656.12.
- Four stages: employer offer, PERM labor certification, Form I-140, then the immigrant visa or adjustment of status.
- Waiting time depends on country of birth. Taiwan- and Hong Kong-born applicants use the worldwide dates (January 1, 2022 in October 2026); mainland China's date is October 1, 2019.
- Typical total time for a new case started in 2026: roughly 4 to 6 years or more.

Born in mainland China, spouse born elsewhere?
Under U.S. immigration law (cross-chargeability), a married couple immigrating together can usually use whichever spouse's country of birth has the shorter wait. A mainland-born applicant married to someone born in Taiwan or Hong Kong may be able to use the worldwide dates.
Already in the U.S.?
When USCIS allows the Date for Filing chart, applicants with valid status can file for adjustment of status, a work permit and a travel document earlier, while waiting for the final action date.

EB-3 unskilled visa: frequently asked questions
How long does the EB-3 unskilled process take?
PERM labor certification usually takes over a year. After that, the wait depends on the monthly Visa Bulletin. With the October 2026 final action date at January 1, 2022 for most countries, new cases should plan for roughly 4 to 6 years or more in total.
Do I need English or work experience?
Most positions require no prior experience. Basic English helps in the employer interview and the visa interview, and some employers set their own language requirement.
Can I bring my family?
Yes. Your spouse and unmarried children under 21 are included as derivative beneficiaries and receive green cards with you.
Can I work in the U.S. while I wait?
If you are abroad, you move to the U.S. when your immigrant visa is issued. If you are already in the U.S. with valid status, you may be able to file for adjustment of status and a work permit once your priority date is current.
Do I have to stay with the sponsoring employer?
You must take the sponsored job with a genuine intent to work there. Once you hold your green card and have worked in the role, you are free to build your career as a permanent resident.
What happens if the employer withdraws?
If an employer withdraws before I-140 approval, the case usually restarts with a new sponsor. Your written agreement explains how fees already paid are handled.
I was born in Taiwan or Hong Kong. Am I counted under China?
No. For the Visa Bulletin, applicants born in Taiwan, Hong Kong or Macau use the worldwide (all chargeability areas) dates, which are currently about two years ahead of mainland China's.
How much does EB-3 unskilled cost in total?
The employer pays all PERM labor certification costs by law. You pay our programme fee, government filing fees for the I-140 (where agreed) and your immigrant visa or adjustment of status, plus medical exams, documents and travel. We give you the full amount in writing, by family size, before you pay anything.
What is the EB-3 Other Workers (unskilled) visa?
It is a U.S. employment-based green card category for permanent, full-time jobs that need less than two years of training or experience. A U.S. employer sponsors the worker through PERM labor certification and Form I-140, and the worker's spouse and unmarried children under 21 can immigrate with them.
Which jobs qualify for EB-3 unskilled?
Permanent, full-time, year-round roles that need less than two years of training or experience, such as fast food crew, food preparation, hotel housekeeping, warehouse work, production line work and some driving roles. Seasonal or temporary jobs do not qualify.
Is there an age limit or English test for EB-3 unskilled?
U.S. immigration law sets no upper age limit and no English test for EB-3 Other Workers. You must be able to do the job, and the employer may set its own requirements, such as basic English for safety or customer service.
